Change child custody in France: documenting a residence change

Changing child custody may mean changing where a child lives or the contact schedule. It does not automatically mean changing parental authority. This guide concerns French law and presenting changed circumstances, without recommending a family arrangement.

How can a child's residence arrangements change?

The official residence guide distinguishes agreement from disagreement. Parents may formalise an agreement; judicial approval gives it enforceable force. Disagreement can be brought before the JAF. During ongoing judicial divorce proceedings, changes are handled with the lawyer.

The child's interests remain central. A move, work schedule or expressed wish does not dictate one outcome by itself. A child capable of discernment may be heard; there is no automatic age at which they decide alone.

What changed circumstances can be documented?

Each item retains its source. A future possibility is not described as an established arrangement. The other parent's disagreement is distinct from an alleged inability to care for the child.

How can a JAF file be prepared?

Separate the current decision, dated changes and supporting documents. The official application and instructions list documents according to the request. A chronology alone neither makes an application nor changes the existing order.
